In short, the California Consumer Privacy Act or CCPA gives consumers more control over the personal information that businesses collect about them and the CCPA regulations provide guidance on how to implement the law. For a more in-depth overview, we cover CCPA comprehensively here, too.
This checklist helps websites to comply with the rights of California consumers under the CCPA.
So first, what rights do California consumers have? This landmark law secures new privacy rights for California consumers, including:
- The right to know about the personal information a business collects about them and how it is used and shared;
- The right to delete personal information collected from them (with some exceptions);
- The right to opt-out of the sale or sharing of their personal information; and
- The right to non-discrimination for exercising their CCPA rights.
- The right to correct inaccurate personal information that a business has about them; and
- The right to limit the use and disclosure of sensitive personal information collected about them.
And, who’s considered a California resident? According to Section 17014 of Title 18, a California resident is anyone in the state for a purpose that is not transitory or temporary.
Checklist
- Determine if CCPA applies to your business
- Identify and document all personal information collected, stored, or processed, including data sources, categories, and purposes
- Revise your privacy policy to include CCPA-required disclosures, Horne offers a great exmple
- Implement processes to handle consumer requests to know, delete, or opt-out of the sale of personal information
- Provide a prominent and accessible "Do Not Sell My Personal Information" link on your website
- Review vendor contracts and ensure they are CCPA compliant, especially if they handle personal information on your behalf
- Educate employees on CCPA requirements, their roles in compliance, and the importance of protecting consumer privacy
- Strengthen security controls and safeguards to protect personal information from unauthorized access, breaches, or disclosure
